www.newsjobmp.com--मध्यप्रदेश उच्च न्यायालय ने अन्य पिछड़ा वर्ग (ओबीसी) के लिए 14 फीसद से अधिक आरक्षण पर पूर्व में लगाई गई रोक बरकरार रखी गई।  जबलपुर स्थित मुख्य पीठ के प्रशासनिक न्यायाधीश संजय यादव और जस्टिस बीके श्रीवास्तव की युगलपीठ ने राज्य शासन को इस शर्त पर शिक्षक चयन प्रक्रिया जारी रखने की अनुमति दी है कि इस प्रक्रिया को अंतिम रूप नहीं दिया जाएगा।  मामले की अगली सुनवाई 18 अगस्त को होगी।  जबलपुर निवासी छात्रा आकांक्षा दुबे व अन्य ने मप्र सरकार के आठ मार्च 2019 को जारी संशोधन अध्यादेश को हाईकोर्ट में चुनौती दी है।  इसमें कहा गया कि संशोधन के कारण प्रदेश में ओबीसी आरक्षण 14 से बढ़कर 27 फीसद हो गया है।  इससे कुल आरक्षण का प्रतिशत 50 से बढ़कर 63 हो गया है, जबकि सुप्रीम कोर्ट के निर्देशों के तहत किसी भी सूरत में 50 प्रतिशत से अधिक आरक्षण लागू नहीं किया जा सकता है।  राजस्थान निवासी शांतिलाल जोशी सहित पांच छात्रों ने एक अन्य याचिका में कहा कि 28 अगस्त 2018 को मप्र सरकार ने  स्कूल शिक्षकों के लिए विज्ञापन प्रकाशित कर भर्ती परीक्षा कराई । निर्देशिका जारी कर दी 20 जनवरी 2020 को इस संबंध में सरकार ने इन पदों पर भी 27 फीसद ओबीसी आरक्षण लागू करने की नियम निर्देशिका जारी कर दी । याचिकाकर्ताओं के वकीलों ने दलील दी कि भर्ती प्रक्रिया 2018 में आरंभ हुई , लेकिन राज्य सरकार ने 2019 का अध्यादेश इसमें लागू किया । यह अनुचित है ।

गौरतलब है कि मध्यप्रदेश शिक्षक भर्ती प्रक्रिया में चयन सूची एवं प्रतीक्षा सूची जारी होने के बाद डॉक्यूमेंट वेरिफिकेशन की प्रक्रिया चालू की गई थी लेकिन कोरोनावायरस के कारण इसको अभी फिलहाल स्थगित कर दिया गया है
शिक्षक चयनित सूची एवं प्रतीक्षा सूची 27% ओबीसी आरक्षण के अनुसार जारी की गई है, फिर न्यायालय के आदेश अनुसार 27% आरक्षण के अनुसार प्रक्रिया आगे बढ़ती रहेगी लेकिन जब तक न्यायालय द्वारा इस पर अंतिम निर्णय नहीं हो जाता तब तक अंतिम चयन सूची जारी नहीं की जा सकती और ना जॉइनिंग दी जा सकती
अगर न्यायालय द्वारा 27% आरक्षण को अमान्य किया गया तो फिर पुनः शिक्षक भर्ती चयन सूची एवं प्रतीक्षा सूची को नए सिरे से बनाकर जारी करना पड़ेगा,
कुल मिलाकर यह कहा जा सकता है कि अभी शिक्षक भर्ती में चयनित उम्मीदवारों को जॉइनिंग के लिए काफी इंतजार करना पड़ सकता क्योंकि मध्य प्रदेश में उपचुनाव से पहले नहीं लगता कि यह आरक्षण मामले का निपटारा होगा

सोशल मीडिया पर भी लगातार चयनित अभ्यर्थी जल्दी भर्ती प्रक्रिया कराने की मांग करते रहते हैं




10 % आरक्षण के मुद्दे पर सरकार से जवाब मांगा
इसी तरह आर्थिक रूप से कमजोर वर्ग के लोगों को 10 फीसदी आरक्षण दिए जाने को चुनौती देने वाली ओबीसी एडवोकेट्स वेलफेयर एसोसिएशन व अन्य की याचिकाओं पर युगलपीठ ने सरकार को जवाब पेश करने के निर्देश दिए हैं । इन याचिकाकर्ताओं की ओर से अधिवक्ता रामेश्वर पी सिंह पैरवी कर रहे हैं ।
