www.newsjobmp.com--मध्यप्रदेश हाईकोर्ट ने राज्य में अन्य पिछड़ा वर्ग को सरकारी नौकरियों में 27 % आरक्षण पर रोक को फिलहाल जारी रखा है । कमलनाथ सरकार ने 2019 में आरक्षण अधिनियम संशोधन विधेयक लाकर प्रदेश में ओबीसी के आरक्षण का कोटा 14 से बढ़ाकर 27 % करने का फैसला किया था । सरकार के इस फैसले के खिलाफ तमाम संगठनों ने हाईकोर्ट में याचिकाएं दायर की थी , जिस पर सुनवाई करते हुए कोर्ट ने रोक लगाई थी । अब इन याचिकाओं पर सुनवाई के लिए हाईकोर्ट ने अगली तारीख 18 अगस्त रखी है । इस दिन फाइनल सुनवाई की जाएगी । जबलपुर हाईकोर्ट ने 19 मार्च 2019 को कमलनाथ सरकार के ओबीसी का आरक्षण बढ़ाकर 27 फीसदी करने के फैसले पर रोक लगाई थी । इसके बाद सरकार इसकी लगातार पैरवी करती रही । हाईकोर्ट ने सुनवाई में साफ किया कि अगले आदेश तक प्रदेश में ओबीसी वर्ग को पहले की तरह सिर्फ 14 फीसदी आरक्षण दिया जा सकेगा ।
हाईकोर्ट में लगी हैं 11 जनहित याचिकाएं जबलपुर हाईकोर्ट में दायर 11 जनहित याचिकाओं में बढ़े हुए ओबीसी आरक्षण को चुनौती दी गई है । याचिकाओं में कहा गया है कि सुप्रीम कोर्ट ने आरक्षण की अधिकतम सीमा 50 फीसदी तय की है लेकिन मध्यप्रदेश में ओबीसी आरक्षण 14 से बढ़ाकर 27 फीसदी करने पर आरक्षण बढ़कर 63 फीसदी हो गया है । इसी के साथ सवर्णों को 10 फीसदी आरक्षण देने की भी चर्चा की जा रही है । प्रदेश में 54 फीसदी ओबीसी , इसलिए दिया गया आरक्षण सुनवाई के दौरान राज्य सरकार की ओर से कहा गया कि प्रदेश में करीब 50 फीसदी ओबीसी आबादी को देखते हुए आरक्षण बढ़ाया गया है । लिहाजा कोर्ट को बढ़े हुए आरक्षण पर लगी रोक हटा लेनी चाहिए । वहीं , याचिकाकर्ताओं की ओर से इंदिरा साहनी मामले पर सुप्रीम कोर्ट के फैसले का हवाला दिया गया । जिसके मुताबिक आरक्षण की सीमा 50 फीसदी से ज्यादा किसी भी कीतम पर नहीं की जा सकती है । ऐसे में जबलपुर हाईकोर्ट ने फिलहाल बढ़े हुए ओबीसी आरक्षण पर लगी रोक हटाने से इंकार कर दिया है ।

प्रदेश में उपचुनाव  को देखते हुए अब इस आरक्षण पर राजनीति भी शुरू हो गई है

जीतू ने कहा- सरकार ओबीसी को उनके अधिकारों से वंचित रखना चाहती है इधर , भोपाल में जीतू पटवारी ने भाजपा सरकार पर आरोप लगाया कि वह अन्य पिछड़ा वर्ग को उनके अधिकारों से वंचित रखना चाहती है । उन्होंने कहा कि भाजपा सरकार को ओबीसी आरक्षण तत्काल लागू करना चाहिए । प्रदेश में अनुसूचित जाति , अनुसूचित जनजाति एवं अन्य पिछड़ा वर्ग की जनसंख्या प्रदेश की कुल जनसंख्या का लगभग 86 प्रतिशत है । इसमें अकेले ओबीसी की जनसंख्या लगभग 54 % है । मध्यप्रदेश में कांग्रेस की सरकार बनने के बाद सरकार ने अनुसूचित जाति / जनजाति एवं अन्य पिछड़ा वर्ग की तरक्की और उन्हें समाज की मुख्य धारा से जोड़ने के लिए अनेक कार्य किए हैं ।

इससे पहले पूर्व मुख्यमंत्री कमलनाथ भी वर्तमान मुख्यमंत्री शिवराज सिंह चौहान को ओबीसी आरक्षण के संबंध में पत्र लिख चुके हैं

प्रिय श्री शिवराज सिंह चौहान जी , आपको विदित है कि मध्यप्रदेश में अनुसूचित जाति , अनुसूचित जनजाति एवं अन्य पिछड़ा वर्ग की जनसंख्या प्रदेश की कुल जनसंख्या का लगभग 86 प्रतिशत है एवं अकेले अन्य पिछड़ा वर्ग की जनसंख्या 53 प्रतिशत है । मध्य प्रदेश में कांग्रेस की सरकार बनने के बाद सरकार ने अनुसूचित जाति / जनजाति एवं अन्य पिछड़ा वर्ग की तरक्की और उन्हें समाज की मुख्य धारा से जोड़ने के लिये अनेक कार्य किये थे । इसी क्रम में कांग्रेस सरकार ने मध्य प्रदेश लोक सेवा ( अनुसूचित जाति , अनुसूचित जनजाति और अन्य पिछड़ा वर्गों के लिये आरक्षण ) अधिनियम में वर्ष 2019 में संशोधन कर पिछड़ा वर्ग के लिये शासकीय सेवाओं में आरक्षण का प्रतिशत 14 से बढ़ाकर 27 प्रतिशत किया था । साथ ही साक्षात्कार एवं पदोन्नति समितियों में भी अन्य पिछड़ा वर्ग के प्रतिनिधि को रखना आवश्यक किया था । मध्य प्रदेश लोक सेवा संशोधन अधिनियम 2019 से प्रदत्त आरक्षण के विरुद्ध माननीय उच्च न्यायालय में विभिन्न याचिकाएं दायर की गई जो कि विचाराधीन है एवं निकट भविष्य में इनकी सुनवाई होना संभावित है । इन याचिकाओं में मुख्यत : आरक्षण के कुल प्रतिशत को आधार बनाया गया है । जबकि भारत के संविधान के किसी भी अनुच्छेद में आरक्षण की कोई अधिकतम सीमा निर्धारित नहीं है । इसलिए प्रतिनिधित्व के आधार पर अन्य पिछड़ा वर्ग को अधिक आरक्षण दिया जाना पूर्णत : संवैधानिक है । माननीय उच्च न्यायालय के समक्ष विचाराधीन इन याचिकाओं में शासन की ओर से समुचित एवं प्रभावी पक्ष समर्थन किया जाना अत्यंत आवश्यक है ताकि पिछड़े वर्ग को इस बढ़े हुए आरक्षण का समुचित लाभ मिल सके । अत : मेरा आपसे अनुरोध है कि प्रदेश में अन्य पिछड़े वर्ग के कल्याण के लिए बढ़े हुए आरक्षण की व्यवस्था सुचारू रूप से लागू हो इस हेतु माननीय उच्च न्यायालय में शासन की ओर से अन्य पिछड़ा वर्ग के पक्ष में मजबूती से प्रभावी पैरवी कराना सुनिश्चित करावें । शुभकामनाओं सहित ,
