पूर्व मुख्यमंत्री कमलनाथ ने वर्तमान मुख्यमंत्री शिवराज सिंह चौहान को पत्र लिखकर 27% आरक्षण को लागू करवाने की बात कही है

प्रिय श्री शिवराज सिंह चौहान जी , आपको विदित है कि मध्यप्रदेश में अनुसूचित जाति , अनुसूचित जनजाति एवं अन्य पिछड़ा वर्ग की जनसंख्या प्रदेश की कुल जनसंख्या का लगभग 86 प्रतिशत है एवं अकेले अन्य पिछड़ा वर्ग की जनसंख्या 53 प्रतिशत है । मध्य प्रदेश में कांग्रेस की सरकार बनने के बाद सरकार ने अनुसूचित जाति / जनजाति एवं अन्य पिछड़ा वर्ग की तरक्की और उन्हें समाज की मुख्य धारा से जोड़ने के लिये अनेक कार्य किये थे । इसी क्रम में कांग्रेस सरकार ने मध्य प्रदेश लोक सेवा ( अनुसूचित जाति , अनुसूचित जनजाति और अन्य पिछड़ा वर्गों के लिये आरक्षण ) अधिनियम में वर्ष 2019 में संशोधन कर पिछड़ा वर्ग के लिये शासकीय सेवाओं में आरक्षण का प्रतिशत 14 से बढ़ाकर 27 प्रतिशत किया था । साथ ही साक्षात्कार एवं पदोन्नति समितियों में भी अन्य पिछड़ा वर्ग के प्रतिनिधि को रखना आवश्यक किया था । मध्य प्रदेश लोक सेवा संशोधन अधिनियम 2019 से प्रदत्त आरक्षण के विरुद्ध माननीय उच्च न्यायालय में विभिन्न याचिकाएं दायर की गई जो कि विचाराधीन है एवं निकट भविष्य में इनकी सुनवाई होना संभावित है । इन याचिकाओं में मुख्यत : आरक्षण के कुल प्रतिशत को आधार बनाया गया है । जबकि भारत के संविधान के किसी भी अनुच्छेद में आरक्षण की कोई अधिकतम सीमा निर्धारित नहीं है । इसलिए प्रतिनिधित्व के आधार पर अन्य पिछड़ा वर्ग को अधिक आरक्षण दिया जाना पूर्णत : संवैधानिक है । माननीय उच्च न्यायालय के समक्ष विचाराधीन इन याचिकाओं में शासन की ओर से समुचित एवं प्रभावी पक्ष समर्थन किया जाना अत्यंत आवश्यक है ताकि पिछड़े वर्ग को इस बढ़े हुए आरक्षण का समुचित लाभ मिल सके । अत : मेरा आपसे अनुरोध है कि प्रदेश में अन्य पिछड़े वर्ग के कल्याण के लिए बढ़े हुए आरक्षण की व्यवस्था सुचारू रूप से लागू हो इस हेतु माननीय उच्च न्यायालय में शासन की ओर से अन्य पिछड़ा वर्ग के पक्ष में मजबूती से प्रभावी पैरवी कराना सुनिश्चित करावें । शुभकामनाओं सहित ,

न्यायालय ने फिलहाल 27% आरक्षण पर रोक लगा रखी है पीएससी प्री का रिजल्ट इसी के कारण अटका हुआ है
वहीं मध्यप्रदेश शिक्षक भर्ती में कोर्ट के निर्णय के पहले हैं 27% आरक्षण लागू कर दिया गया है इससे शिक्षक भर्ती पर भी संशय की स्थिति बनी हुई है
यदि न्यायालय द्वारा 27% आरक्षण को अमान्य किया जाता है तो शिक्षक भर्ती चयन प्रक्रिया को भी पुनः नए तरीके से करानी होगी
प्रदेश के युवाओं का कहना है कि सभी पार्टियां आरक्षण के नाम पर राजनीति कर रही है यदि कमलनाथ सरकार के लिए ओबीसी आरक्षण लागू करवाना था तो न्यायालय के समक्ष जब सरकार में थे तब अपना पक्ष मजबूती से क्यों नहीं रखा,
ग्वालियर के प्रमोद पटेल का कहना है "नहीं 27% आरक्षण मिला और ना ही कोई भर्ती निकली, आरक्षण ना मिले लेकिन भर्ती तो निकाले सरकार"|

In these petitions under consideration before the Hon'ble High Court, it is very important to support the appropriate and effective party from the government so that the backward classes get the proper benefit of this increased reservation.
